Міжнародний кримінальний судСторони співробітничають з метою зміцнення миру та міжнародного правосуддя шляхом ратифікації та імплементації Римського статуту Міжнародного кримінального суду (МКС) 1998 року та пов’язаних з ним документів.

Верховенство права та повага до прав людини і основоположних свободВ рамках співробітництва у сфері юстиції, свободи та безпеки Сторони надають особливого значення утвердженню верховенства права та укріпленню інституцій усіх рівнів у сфері управління загалом та правоохоронних і судових органів зокрема. Співробітництво буде спрямоване, зокрема, на зміцнення судової влади, підвищення її ефективності, гарантування її незалежності та неупередженості та боротьбу з корупцією. Співробітництво у сфері юстиції, свободи та безпеки буде відбуватися на основі принципу поваги до прав людини та основоположних свобод.

Захист персональних данихСторони домовились співробітничати з метою забезпечення належного рівня захисту персональних даних відповідно до найвищих європейських та міжнародних стандартів, зокрема відповідних документів Ради Європи. Співробітництво у сфері захисту персональних даних може включати, inter alia, обмін інформацією та експертами.

Співробітництво у сфері міграції, притулку та управління кордонами.

Сторони підтверджують важливість спільного управління міграційними потоками між їхніми територіями та надалі розвиватимуть всеохоплюючий діалог щодо всіх питань у сфері міграції, зокрема нелегальної міграції, легальної міграції, незаконного переправлення осіб через державний кордон та торгівлі людьми, а також включення проблемних питань у сфері міграції до національних стратегій економічного та соціального розвитку регіонів, звідки походять мігранти. Такий діалог ґрунтується на основоположних принципах солідарності, взаємної довіри, спільної відповідальності та партнерства.

Згідно з відповідним законодавством ЄС та чинним національним законодавством, співробітництво буде, зокрема, зосереджуватись на:.

Подоланні причин виникнення міграції, активно використовуючи можливості співробітництва у цій сфері з третіми країнами та в рамках міжнародних форумів.

Спільному запровадженні ефективної та превентивної політики щодо боротьби з нелегальною міграцією, незаконним переправленням нелегальних мігрантів через державний кордон та торгівлею людьми, у тому числі щодо методів боротьби з організованими злочинними групами, що здійснюють незаконне переправлення нелегальних мігрантів через державний кордон та торгівлю людьми, а також захисту жертв таких злочинів.

Запровадженні всеохоплюючого діалогу з питань притулку, зокрема стосовно практичних аспектів реалізації Конвенції ООН про статус біженців 1951 року, Протоколу щодо статусу біженців 1967 року та інших відповідних міжнародних документів, а також шляхом забезпечення поваги принципу «невислання».

Зусилля Сторін у цій сфері будуть спрямовані на ефективну імплементацію принципу інтегрованого управління кордонами.

Відповідно до законів, умов та процедур, що застосовуються у державі-члені та в ЄС, ставлення до працівників, які є громадянами України та які законно працевлаштовані на території держави-члена, має бути вільним від будь-якої дискримінації на підставі громадянства стосовно умов праці, винагороди або звільнення порівняно з громадянами цієї держави-члена.

Україна відповідно до законів, умов та процедур, що застосовуються на її території, повинна забезпечити ставлення, згадане у пункті 1 цієї статті, до працівників, які є громадянами держави-члена та на законних підставах працевлаштовані на її території.

Беручи до уваги ситуацію на ринку праці держав-членів згідно з їхнім законодавством та відповідно до норм, чинних у державах-членах та в ЄС, у сфері мобільності працівників:.

Існуючі можливості доступу до зайнятості для українських працівників, надані державами-членами згідно з двосторонніми договорами, мають бути збережені та, у разі можливості, покращені.

Інші держави-члени повинні вивчити можливість укладання подібних договорів.

Рада асоціації зобов’язується розглянути можливість надання інших більш сприятливих положень у додаткових сферах, зокрема можливості доступу до професійного навчання, згідно із законами, умовами та процедурами, чинними у державах-членах та в ЄС, при цьому беручи до уваги ситуацію на ринку праці у державах-членах та в ЄС.

Сторони забезпечують повне виконання:.

Сторони також прагнуть досягти посилення мобільності громадян і подальшого прогресу у візовому діалозі.

Сторони зобов’язуються вжити послідовних кроків до встановлення безвізового режиму у відповідний час після створення умов для добре керованого і безпечного пересування людей, визначених у двофазовому Плані дій щодо лібералізації візового режиму, представленого на Саміті Україна - ЄС 22 листопада 2010 року.

Сторони співробітничають у питаннях, що стосуються боротьби з незаконним обігом наркотиків, ґрунтуючись на спільно погоджених принципах, що відповідають міжнародним конвенціям у цій сфері, при цьому беручи до уваги Політичну декларацію та Декларацію про керівні принципи скорочення попиту на наркотики, прийняті на двадцятій спеціальній сесії Генеральної Асамблеї Організації Об’єднаних Націй з боротьби з наркотиками у червні 1998 року.

Таке співробітництво спрямоване на боротьбу з незаконним обігом наркотиків, зменшення обсягів постачання, торгівлі та попиту на наркотики, боротьбу з наслідками для здоров’я та соціальними наслідками наркозалежності, а також на більш ефективне запобігання відводу хімічних прекурсорів, що використовуються для нелегального виробництва наркотиків та психотропних речовин.

Сторони використовують необхідні методи співробітництва для досягнення зазначених цілей, забезпечуючи збалансований та інтегрований підхід до зазначених питань.

Сторони співробітничають у боротьбі з кримінальною та незаконною організованою чи іншою діяльністю, а також з метою її попередження.

Таке співробітництво спрямовується на вирішення, inter alia, таких проблем:.

Незаконне переправлення через державний кордон нелегальних мігрантів, торгівля людьми і вогнепальною зброєю та незаконний обіг наркотиків.

Корупція як у приватному, так і в державному секторі.

Сторони посилюють двостороннє, регіональне та міжнародне співробітництво у цій сфері, зокрема співробітництво із залученням Європолу. Сторони і надалі розвивають співробітництво, inter alia, стосовно:.

Обміну найкращими практиками, в тому числі щодо методик розслідування та криміналістичних досліджень.

Обміну інформацією відповідно до існуючих правил.

Посилення потенціалу, зокрема навчання та, у разі необхідності, обмін персоналом.

Питань, пов’язаних із захистом свідків та жертв.

Сторони віддані ефективному виконанню Конвенції ООН проти транснаціональної організованої злочинності 2000 року та трьох Протоколів до неї, Конвенції ООН проти корупції 2003 року та інших відповідних міжнародних документів.

Сторони домовились надалі розвивати судове співробітництво у цивільних та кримінальних справах, повною мірою використовуючи відповідні міжнародні і двосторонні документи та ґрунтуючись на принципах юридичної визначеності і праві на справедливий суд.

Сторони домовилися розвивати подальше судове співробітництво між Україною та ЄС у цивільних справах на основі відповідних багатосторонніх правових документів, зокрема конвенцій Гаазької конференції з міжнародного приватного права у сферах міжнародного правового співробітництва, судового процесу, а також захисту дітей.

Стосовно судового співробітництва в кримінальних справах Сторони намагаються посилити взаємодію щодо взаємної правової допомоги та екстрадиції. Це включатиме, у разі необхідності, приєднання до відповідних міжнародних документів ООН та Ради Європи, зокрема Римського статуту Міжнародного кримінального суду 1998 року, та їх виконання, як зазначається у статті 8 цієї Угоди, а також більш тісне співробітництво з Євроюстом.

У сфері боротьби із шахрайством: удосконалення методів, спрямованих на припинення шахрайства і корупції та запобігання цим явищам у сферах, що охоплюються Главою 3 Розділу V («Економічне та галузеве співробітництво»), зокрема співробітництво між відповідними адміністративними органами.
